Terms of Service

These Terms of Service ("Terms") govern your access to and use of the NextCourt mobile application, websites and related services (together, the "Service"), operated by NextCourt ("we", "us"). By creating an account or using the Service you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
1. What NextCourt is
NextCourt is a platform for racket sports — tennis, padel, pickleball and beach tennis — that helps players find courts and partners, record matches, join communities, tournaments and leagues, connect with coaches, and track their progress. Parts of the Service are currently in beta: features may change, be added or be removed without notice, and occasional interruptions or data resets may occur.
2. Eligibility
You must be at least 18 years old to use the Service. By using it you confirm that you are 18 or older and able to enter into a binding agreement.
3. Your account
- Provide accurate information and keep it up to date.
- You are responsible for activity on your account and for keeping your credentials secure.
- One account per person. Do not impersonate others or misrepresent your skill level in ways that harm fair play.
- You may delete your account at any time in the app (Profile → Privacy); see the Privacy Policy for how deletion works.
4. Subscriptions and purchases
- During the beta the Service is free. Paid plans will be offered at launch; prices will be shown before you subscribe.
- Subscriptions may be purchased through the Apple App Store or Google Play, or through the NextCourt web portal, where available.
- Store purchases are billed by Apple or Google, and the respective store's terms govern billing, renewal, cancellation and refunds. Manage or cancel those subscriptions in your store account settings.
- Web purchases are billed by us through our payment processor. They renew automatically until cancelled; you can cancel at any time, effective at the end of the current billing period, and refunds are handled in accordance with applicable law. Manage or cancel those subscriptions in the portal.
- Your subscription unlocks the same benefits regardless of where you purchased it. Manage each subscription in the channel where it was purchased.
- Prices and plan benefits may change; changes apply prospectively and will be communicated in advance.
5. Coaches and lessons
- Coaches on NextCourt are independent professionals, not our employees or agents. We provide scheduling and communication tools; the coaching relationship — including lesson quality, safety and, during the beta, payment arrangements made directly between coach and student — is between you and the coach.
- We do not vet, certify or guarantee any coach. Reviews reflect the opinions of their authors.
6. Tournaments, leagues and community events
- Tournaments and events on the platform may be created by us, by clubs and communities, or by independent organizers. The organizer is responsible for the event's rules, schedule, venue and any entry fees, which during the beta may be collected outside the platform.
- Match results, standings and rankings are recorded through the Service and may be visible to other users.
7. Assumption of risk
Racket sports are physical activities that carry an inherent risk of injury. You participate in matches, lessons, training sessions and events found or arranged through the Service at your own risk. Consult a physician before beginning any exercise program. We do not control courts, venues, playing conditions or other participants, and we are not responsible for injuries, accidents or disputes that occur on or off court.
8. Your content
- You keep ownership of the content you post (photos, messages, reviews, match records). You grant us a worldwide, non-exclusive, royalty-free license to host, display and distribute that content as needed to operate and promote the Service (for example, showing your match card to the players involved).
- Post only content you have the right to share. Do not post content that is unlawful, hateful, harassing, sexually explicit, violent or deceptive.
- We may remove content or restrict accounts that violate these Terms.
9. Acceptable use
You agree not to:
- Use the Service for any unlawful purpose or in violation of these Terms.
- Harass, threaten or discriminate against other users, on or off court.
- Scrape, copy, reverse-engineer or interfere with the Service or its security.
- Manipulate rankings, reviews or match results.
- Use the Service to send spam or unauthorized advertising.
10. Intellectual property
The Service — including the NextCourt name, logo, design and software — is owned by us or our licensors and protected by intellectual-property laws. We grant you a personal, limited, non-transferable license to use the app for its intended purpose. "The Game Has Changed" and the NextCourt marks may not be used without our permission.
11. Third-party services
The Service relies on third-party providers (such as app stores, maps, push notifications and payment processors) and may link to third-party sites. We are not responsible for third-party services, and their own terms apply to your use of them.
12. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or if we discontinue the Service. Sections that by their nature should survive (including 7, 8, 10, 13 and 14) survive termination.
13. Disclaimers and limitation of liability
The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy or uninterrupted availability — expectations we work hard to meet, but which we cannot guarantee during a beta. To the maximum extent permitted by law, NextCourt will not be liable for indirect, incidental, special, consequential or punitive damages, or for loss of data, profits or goodwill, arising from your use of the Service. To the extent permitted by law, our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the twelve months before the claim or US$ 100.
14. Indemnification
You agree to indemnify and hold NextCourt harmless from claims, damages and expenses (including reasonable attorneys' fees) arising from your content, your use of the Service or your violation of these Terms.
15. International use
NextCourt is available to players around the world. The Service is operated from the United States; features, plans and partner programs may vary by country, and you are responsible for complying with the laws that apply where you use the Service. Nothing in these Terms limits any mandatory consumer rights you have under the laws of your country of residence.
16. Governing law
NextCourt is headquartered in Florida, USA. These Terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-law rules, and disputes will be resolved in the state or federal courts located in Florida — except where the mandatory consumer-protection laws of your country of residence provide otherwise.
17. Changes to these Terms
We may update these Terms from time to time. We will revise the "Last updated" date above and, for material changes, notify you in the app. Continuing to use the Service after changes take effect means you accept the updated Terms.
