These Terms of Service ("Terms") govern your access to and use of the NextCourt mobile application, websites and related services (together, the "Service"), operated by NextCourt ("we", "us"). By creating an account or using the Service you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. What NextCourt is

NextCourt is a platform for racket sports — tennis, padel, pickleball and beach tennis — that helps players find courts and partners, record matches, join communities, tournaments and leagues, connect with coaches, and track their progress. Parts of the Service are currently in beta: features may change, be added or be removed without notice, and occasional interruptions or data resets may occur.

You must be at least 18 years old to use the Service. By using it you confirm that you are 18 or older and able to enter into a binding agreement.

7. Assumption of risk

Racket sports are physical activities that carry an inherent risk of injury. You participate in matches, lessons, training sessions and events found or arranged through the Service at your own risk. Consult a physician before beginning any exercise program. We do not control courts, venues, playing conditions or other participants, and we are not responsible for injuries, accidents or disputes that occur on or off court.

The Service — including the NextCourt name, logo, design and software — is owned by us or our licensors and protected by intellectual-property laws. We grant you a personal, limited, non-transferable license to use the app for its intended purpose. "The Game Has Changed" and the NextCourt marks may not be used without our permission.

11. Third-party services

The Service relies on third-party providers (such as app stores, maps, push notifications and payment processors) and may link to third-party sites. We are not responsible for third-party services, and their own terms apply to your use of them.

12. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or if we discontinue the Service. Sections that by their nature should survive (including 7, 8, 10, 13 and 14) survive termination.

13. Disclaimers and limitation of liability

The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy or uninterrupted availability — expectations we work hard to meet, but which we cannot guarantee during a beta. To the maximum extent permitted by law, NextCourt will not be liable for indirect, incidental, special, consequential or punitive damages, or for loss of data, profits or goodwill, arising from your use of the Service. To the extent permitted by law, our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the twelve months before the claim or US$ 100.

You agree to indemnify and hold NextCourt harmless from claims, damages and expenses (including reasonable attorneys' fees) arising from your content, your use of the Service or your violation of these Terms.

15. International use

NextCourt is available to players around the world. The Service is operated from the United States; features, plans and partner programs may vary by country, and you are responsible for complying with the laws that apply where you use the Service. Nothing in these Terms limits any mandatory consumer rights you have under the laws of your country of residence.

16. Governing law

NextCourt is headquartered in Florida, USA. These Terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-law rules, and disputes will be resolved in the state or federal courts located in Florida — except where the mandatory consumer-protection laws of your country of residence provide otherwise.

17. Changes to these Terms

We may update these Terms from time to time. We will revise the "Last updated" date above and, for material changes, notify you in the app. Continuing to use the Service after changes take effect means you accept the updated Terms.
